Terms of Use for the SGS Academy

1. Scope of Application for Terms of Use 
These Terms of Use apply to the online services offered by the SGS Academy.

2. User Account 
(1)	It is necessary to create a user account to use our services to book courses. A username and password ("login data") are required to create the account.  
(2)	A current email address for the user is required to create a user account. This email address also serves as the method of communicating with SGS.
(3)	In the user account, users can administer their personal data and retrieve certificates for the courses they have completed successfully. The user account can also be used to book courses at the SGS Academy.

3. Bookings and Usage 
(1)	Users can choose and book one or more courses from the online catalog on the SGS Academy’s website. The shop page guides the user through the steps of the booking process.
(2)	A course will only take place when the minimum number of required participants has been reached. Furthermore, and unless otherwise specified, the Regulamento SGS Academy apply and can be retrieved from our shop web page.
(3)	Users will promptly receive an invoice with the course fees for the course booked before the course begins. Unless otherwise stated, the terms of payment are derived from the SGS Academy’s Rules found on our website. 

4. Usage Rights 
The entire content of our website, including the texts, images, graphics, audio and video data, are our property and may not be copied, modified, transmitted, reused, made newly available, exploited or otherwise used for public or commercial purposes without our prior written consent unless expressly stated otherwise. We would like to point out that a violation of our copyrights or other protective rights may result in civil and/or criminal law consequences.

5. Liability 
(1) Website Content 
We assume no liability for the timeliness, accuracy, completeness or quality of the information available in the online offers. Liability claims made against the author based on material or non-material damages that were caused either by the use or non-use of the content presented or by the use of incorrect or incomplete content are generally excluded provided there is no proof that we were willfully or grossly negligent. All offers are non-binding. We expressly reserve the right to change, supplement or delete individual pages or all online offers without prior notice or terminate offers for a specified period of time or permanently.
(2) Website Use 
The use of this website and the downloading of data shall be undertaken at your own risk. We assume no responsibility for any damages resulting from downloads, particular any damage to the user’s existing data, hardware and/or software.

Cancellation Policy

Right of Cancellation
As a consumer, you have the right to cancel this contract, without reason, within 14 days from the day of the conclusion of the contract, under Decreto-Lei n.º 24/2014 de 14 de fevereiro that transposed into Portuguese law the Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011
To exercise your right of cancellation, you are required to inform us of your decision to cancel the contract by means of a clear statement (e.g., by letter, fax or email). You may use the attached sample cancellation notification form, but you are not obliged to do so.
To meet the cancellation deadline, it is sufficient that you send your notice before the end of the cancellation notice period, communicating that you are exercising your right of cancellation. 

Consequences of Cancellation 
Should you cancel this contract, you will lose your booking in our training portal for the SGS online course. If we have already received payment from you within the cancellation period deadline, you will be reimbursed for this payment immediately and no later than 14 days from the date of our receipt of your cancellation notice. Unless agreed with you otherwise, we will use the same method of payment for reimbursement that you used for your payment. Under no circumstances will you be charged any fees for this reimbursement.

Privacy Statement 

The subsidiaries (SGS Portugal – Sociedade Geral de Superintendência, S.A. (NIPC: 500417660), SGS Molecular – Inovação e Serviços em Biotecnologia, S. A. (NIPC: 506604233), and SGS/International Certification Services – Serviços Internacional de Certificação, Lda. (NIPC: 504254960) organized under SGS Group in Portugal ("SGS") take security and data protection regard-ing the personal data obtained in the course of their activities very seriously. For this reason, our websites are operated in accordance with the respective applicable laws on data protection, such as the General Data Protection Regulation (“GDPR”) and the Lei n.º 58/2019 de 8 de agosto. I. Our Views On Data Protection

The companies of the SGS strive to provide most of the services on their respective websites for anonymous use. In this case, anonymous means that personal data of individuals is not collected.

If, however, the storage of your personal data is required, we will store the data only in accordance with the applicable laws or within the framework of a consent issued by you and use this data in ac-cordance with the purpose we have specified and informed you of. Without your explicit consent, SGS Group companies in Portugal will not forward any personal data to third parties, unless SGS is legally bound to do so. 

II. Which Data Do We Collect?

In general, you can use and access all the SGS websites without having to process any of your per-sonal information.

You can search our website anonymously to find out about the offers and content on our e-learning platform. If you would like to use our e-learning platform to book courses, we would require personal data from you to process your booking.

When using other SGS websites, however, certain SGS company websites may process one or more of the following types of data in order to offer better products and services and provide you the op-tion to submit an application online:

1. Data for personal identification
Personal data is data that makes your identification possible. Personal data is required when you order a service from SGS, create an account, send us feedback, receive a newsletter or submit an application online. Personal data includes, for example, the name, date of birth, address (both billing and home address), email address, telephone number, the IP address from which you access the site and the means of payment.

2. Data without personal identification

Data without identification of the person refers to such data that is merely statistical in nature and on its own does not identify a specific natural or legal person. This data includes, for example, the in-formation on the sector and product.

3. Access to our web pages and cookies

Any access to our web pages and any retrieval of the data stored on these pages is protocolled. This serves internal system-related and statistical purposes. The following information is protocolled: IP addresses of the requesting computers, messages via the web browser and requesting domain, name of the page called up, name of the file retrieved, transferred data volume and date and time of the retrieval. Any additional personal data will only be recorded when you as a user of our websites volun-tarily provide information, for example, in the context of an inquiry or registration, or when concluding a contract.

Our web pages use cookies. A cookie is a text file that is sent automatically when you visit a website and is temporarily stored on the hard disk of the Computer of the website user as an anonymous identifier. Cookies facilitate the use of our websites. Cookies serve, for example, to improve the con-nection to our websites during your visit and provide more effective support when you return to one of our websites. Only the data that a server sends and/or which you enter upon request is stored. Such data includes, for example, information on the domain, path, settings, login dates and expira-tion date. Cookies contain purely technical information and, as a rule, are not used to identify you individually. A cookie cannot spy on a hard disk. If you wish, you can generally restrict the storage of cookies via your web browser or decide whether you want to allow storage only with your prior agreement. 4. Usage of your data in SGS Academy

SGS offers e-Learning content worldwide from a single platform. This e-learning platform is provided by the company Seertech Solutions PTY LTD, Level 7, Suite 701, 59 Goulburn Street, Haymarket, NSW 2000 Australia www.seertechsolutions.com. The European branch of Seertech Solutions is located at 200 Aldersgate Street, London EC1A 4HD, UK. The data for iPlus e-learning for the region Europe, Middle East and Africa is hosted on cloud service provider Amazon Web Services (AWS). 

AWS is certified to a number of standards including ISO27001 and SOC2, more information can be found at https://aws.amazon.com/compliance/.

You can first take a look at the catalog of training courses in SGS Academy. When doing so, none of your personal data will be stored. If you choose to create a personal account in SGS Academy, the following personal data will be processed in your account: surname, first name, address, organiza-tion/employer and email address. We require this personal data to enable you to participate in SGS e-learning courses and to allow SGS to administer the booked courses and payments and to be able to send you learning materials, notifications and certificates.

In the course of setting up your customer account in SGS Academy, a cookie from SGS Academy will be created that will save your login data. This saves you from having to re-enter your login infor-mation and settings for SGS Academy each time you re-enter the page. However, if you wish, you also have the option to refuse the storage of cookies.

All of the courses offered by SGS that you have successfully participated in will be managed in your personal SGS Academy account. The certificates earned are stored on the iPlus/AWS servers in the Dublin AWS region and can be retrieved at any time. In the event you wish to delete your personal ac-count, please note that SGS will keep the certificates for only a limited period of time.

Our courses are held by Trainers. Each course is intended to provide an optimum experience and learning result. To ensure this, our Trainers need to prepare themselves taking the current knowledge and experience of the participants of a course into account. To enable the trainers to gain this infor-mation they can access the Participant Information of the course assigned to them and are provided with your Name, E-Mail-Address and (if applicable) the company where you work. This information is exclusively used for preparation of the course and not for any other means.
Your SGS Academy E-Learning personal data will not be used for purposes other than those listed here.

III. What Happens To The Data Collected?

With your prior consent, personal data may be included in our contact and administration databases. This enables us to maintain our relationship with you more efficiently and help us select interesting topics and offers for you and send you the relevant information material.
The evaluation of data without personal identification is common and necessary to ensure the server's operation and to create general access statistics in order to make our offers more user-friendly so that we can meet the desires and needs of our users. This data is not combined with other data sources and is deleted following a statistical evaluation.

IV. Does SGS Pass On The Data It Receives To Third Parties?

Data about our customers, our applicants or interested parties are an important element in our suc-cessful business activities. Therefore, under no circumstances does SGS sell the data it receives to third parties.
Generally, the information you provide to SGS company web pages is collected exclusively in the databases of the respective individual SGS company. Only in exceptional cases will it be passed on to other SGS companies. Should this occur, you will be informed prior to the data collection, and you may choose whether or not to expressly agree to the data transfer.

SGS companies passes on the personal data received from you online only in the following cases:

1.	When it is necessary to transfer personal data to another SGS company in order to fulfill the purpose for which the information was provided.

2.	When data is entered on an SGS company website, for example, as part of an application process, this data is forwarded to other SGS companies (also internationally) provided that you explicitly agree to this process.

3.	Only to the extent necessary when forwarding data to third parties and subcontractors who perform specific tasks on behalf of SGS to enable them to fulfill their tasks within the scope of the storage and use of your personal data as defined by SGS and in accordance with the respective applicable laws on data protection.

4.	When SGS has a legal obligation to disclose your data. This will be the case when govern-ment institutions (for example, law enforcement authorities) request information from us or when we receive a court order to provide this information, or when the provision of such in-formation is necessary to comply with SGS legal obligations, justification or protection of le-gal claims or the defense of SGS against legal complaints. In these cases, we will protect the confidentiality of your identity.

V. How Does SGS Protect Your Information?

Your personal data provided to us will be secured using the appropriate technical and organizational measures in such a way that they are inaccessible by unauthorized third parties. Only authorized SGS employees will have access to your personal data. Personal data will only be passed on to third parties when this is necessary for the performance of a contract concluded with you for an SGS service and/or in individual cases where a legal obligation exists. You will always be informed about the respective objective that justifies the transfer of your personal data to third parties.

SGS company websites may contain links to other websites. SGS has no influence on these sites and therefore does not accept any liability for the privacy policies or content of these other websites.

VI. Until When Will My Personal Data Be Stored?

The period of time during which data is stored varies depending on the purpose for which the infor-mation is collected and processed. In cases where there is no specific legal requirement, certificates obtained from SGS online courses will be stored together with my client data in SGS systems for a period of 5 years after the last interaction you had with SGS. These data will be irrevocably excluded after the expiry of that period. If I decide to reactivate my customer account within 5 years, SGS will make the deactivated customer account again, including stored certificates, available for my use.
VI. Can I Oppose to the storage of my personal data?

At any time, you have the option of opposing the storage of such data by SGS. If you choose to do so, SGS will delete personal data within the limits of the law and deactivate your customer account. SGS will deactivate your customer account if it opposes the storage of your personal data and the maintenance of the contractual relationship. During this deactivation SGS will send the certificates obtained through SGS online courses in an attachment in PDF format to the email address registered in your customer account. We warn you that you are responsible for ensuring that documents are securely filed in your own system.

VII. Your Rights

As data holder, SGS recognizes the following rights enshrined in the GDPR:

1. Access: you can obtain information regarding the processing of your personal data and a copy of the data.

2. Deletion: you can require deletion of your personal data, within the limits of the law.

3. Opposition: you can oppose the data processing, based on a particular situation. In cases of op-position to the treatment, SGS will have the right to analyze the request, which will not be accepted if there are legitimate reasons to continue with the processing, which must prevail, over the rights, free-doms and interests of the holder.

4. Rectification: when your personal data is incorrect or incomplete, you can require that such data be changed.

5. Limitation: you can require limiting the processing of your personal data.

6. Withdrawal of consent: when your consent has been given for the data processing, it may be with-drawn at any time.

7. Data Portability: whenever legally permitted, you have the right to receive the personal data you have provided, when technically possible, or transferred to a third party.

SGS seeks to maintain a good relationship with its customers and resolve their issues in a satisfacto-ry manner. If you are not satisfied with the SGS response or with the processing of your personal data, contact us using the means mentioned bellow. You have the right to file a complaint with the supervisory authority - the Comissão Nacional de Proteção de Dados – according to the GDPR, the Lei n.º 58/2019 de 8 de agosto and the current national legislation.

We also inform that our employees are obliged to process personal data and ensure its confidentiali-ty in accordance with the GDPR, the Lei n.º 58/2019 de 8 de agosto and the current national legisla-tion.
